At issue in this appeal before the Pennsylvania Supreme Court was the "breadth of gubernatorial power" concerning home health care services, and whether Pennsylvania Governor Thomas Wolf's executive order (2015-05) was an impermissible exercise of his authority. The Order focused on the in-home personal (non-medical) services provided by direct care workers (“DCW”) to elderly and disabled residents who receive benefits in the form of DCW services in their home rather than institutional settings (“participants”), pursuant to the Attendant Care Services Act (“Act 150”). After careful consideration of the Order, the Supreme Court concluded Governor Wolf did not exceed his constitutional powers. This appeal centered on a challenge to the practice of requiring private attorneys who may be privy to confidential information related to a grand jury investigation to commit to maintaining the secrecy of all information they may acquire regarding the grand jury. The 40th Statewide Investigating Grand Jury was convened in 2016. Under the authority of the 40th Statewide Investigating Grand Jury, subpoenas requiring the production of documents were recently issued to the Dioceses of Harrisburg and Greensburg (“Appellants” or the “Dioceses”). Their counsel requested a copy of the notice of submission that the Office of the Attorney General (the “OAG”) had provided to the supervising judge. The supervising judge replied that he would furnish a copy of this notice to counsel, but that counsel first would be required to sign and submit appearance form, which included an oath or affirmation to keep all that transpired in the Grand Jury room secret (under threat of penalty of contempt). Counsel declined to accept these terms, however, and Appellants lodged a joint motion to strike the non-disclosure provision from the entry-of-appearance form. They argued that the requirement of secrecy was not authorized by the Investigating Grand Jury Act, both as to the obligation being imposed upon counsel and, alternatively, in terms of the breadth of that duty. The Dioceses’ lead contention was that the secrecy requirement of 42 Pa.C.S.A. Section 4549(b) did not apply to private attorneys, positing that, “[b]y its terms,” Section 4549(b) applies only to persons who are “sworn to secrecy” -- i.e., those who are required in practice to sign an oath of secrecy -- such as “Commonwealth attorneys, grand jurors, stenographers, typists, and operators of recording equipment.” The Pennsylvania Supreme Court concluded an attorney would will be privy to matters occurring before an investigating grand jury shall be sworn to secrecy per the requirements of the Investigating Grand Jury Act, either via an appropriately tailored entry-of-appearance form or otherwise. The obligation of confidentially generally extends to all matters occurring before the grand jury, which includes, but is not limited to, what transpires in a grand jury room. A lawyer otherwise subject to secrecy, however, may disclose a client’s own testimony to the extent that the client would otherwise be free to do so under applicable law. Such disclosure is also subject to the client’s express, knowing, voluntary, and informed consent; the Rules of Professional Conduct; and specific curtailment by a supervising judge in discrete matters following a hearing based on cause shown. Three disabled individuals who formerly received cash general assistance benefits from the Pennsylvania Department of Public Welfare filed a complaint alleging that the manner in which the Pennsylvania General Assembly enacted Act 80 of 2012, a piece of legislation which, inter alia, made sweeping changes to the administration of the state's human services programs, violated Article III, Sections 1, 3 and 4 of the Pennsylvania Constitution. The Pennsylvania Supreme Court determined the Act was in violation of Section 4. The provisions of H.B 1261, P.N. 1385 were entirely removed from the bill by the Senate, inasmuch as they had been enacted by another piece of legislation, Act 22 of 2011. Since the original provisions were gone when the new provisions were added by the Senate, it was factually and legally impossible for the new provisions to work together with the deleted provisions to accomplish a single purpose. The Court held the amendments "to such enfeebled legislation" were not germane as a matter of law. Consequently, the Senate amendments were not germane to the provisions of H.B. 1261, P.N. 1385, and, accordingly, the three times that H.B. 1261, P.N. 1385 was passed by the House in 2011 could not count towards the requirements of Article III, Section 4. The Pennsylvania Supreme Court allowed this appeal to address the City of Philadelphia's so-called "soda tax." In June 2016, City Council enacted the challenged ordinance, which imposed a tax regarding specified categories of drinks sold, or intended to be sold, in the municipal limits. Appellants -- a group of consumers, retailers, distributors, producers, and trade associations -- filed suit against the City and the Commissioner of the Philadelphia Department of Revenue, in the court of common pleas, challenging the legality and constitutionality of the tax and seeking declaratory and injunctive relief. The common pleas court differentiated the soda tax as a “non-retail, distribution level tax” and that the tax did not apply to the same transaction or subject as the state sales tax, thus, no violation of the "Sterling Act," Act of August 5, 1932, Ex. Sess., P.L. 45 (as amended 53 P.S. sections 15971–15973). A divided, en banc panel of the Commonwealth Court affirmed, the majority reasoning that in determining whether a tax was duplicative, the focus is upon the incidence of the tax; such incidence is ultimately determined according to the substantive text of the enabling legislation; and the concept of legal incidence does not concern post-tax economic actions of private actors. Because the City’s beverage tax and the state sales and use tax are imposed on different, albeit related, transactions and measured on distinct terms, the majority likewise concluded that the Sterling Act was not offended. The Supreme Court affirmed, finding that the Sterling Act conferred upon the City "a broad taxing power subject to preemption," while clarifying that “any and all subjects” are available for local taxation which the Commonwealth could, but does not presently, tax. The Commonwealth could, but did not, tax the distributor/dealer-level transactions or subjects targeted by the soda tax. Fu Xiang Lin began performing remodeling work for Eastern Taste, a restaurant that had not yet opened for business. Lin and three other individuals were hired by Lin’s sister-in-law, Sai Zheng Zheng, who was the owner of Eastern Taste. They did not sign a written contract, but Lin was to be paid for his services on a per diem basis. Lin had worked in remodeling for fifteen years, and he was the most experienced individual involved in the project. Although Wang purchased the materials necessary for the project, Lin brought and used his own tools. Lin was hired only to complete the remodeling work. While repairing a chimney, Lin fell from a beam and landed on a cement floor, suffering serious injuries. In addition to numerous bone fractures, the impact caused trauma to Lin’s spinal cord, rendering him paraplegic. Lin filed a workers’ compensation claim petition against Eastern Taste. Because Eastern Taste did not maintain workers’ compensation insurance, Lin additionally filed a petition for benefits from the Uninsured Employers Guaranty Fund (the “Fund”). Both Eastern Taste and the Fund filed answers denying, inter alia, the existence of an employment relationship. In this appeal, the issue before the Pennsylvania Supreme Court was whether, pursuant to the Construction Workplace Misclassification Act (“CWMA” or “the Act”), Lin was eligible for compensation under the Workers’ Compensation Act. The Commonwealth Court determined that the CWMA was inapplicable under these circumstances, that the claimant otherwise failed to establish that he was an employee of the restaurant, and that he accordingly was ineligible for workers’ compensation benefits. The Pennsylvania Workers’ Compensation Act (“WCA”) makes an employer liable for paying the disability benefits and medical expenses of an employee who sustains an injury in the course of his or her employment. In January 1993, Craig Whitmoyer suffered a work-related injury that resulted in the amputation of part of his arm. Starting at that time, his employer, Mountain Country Meats (“MCM”), or MCM’s insurance carrier, Selective Insurance (“Selective”), paid all of Whitmoyer’s medical expenses related to this injury. A few months later, the parties reached an agreement related to Whitmoyer’s disability benefits – he was entitled “to a 20 week healing period and 370 weeks of specific loss benefits [at $237.50 per week after May 22, 1993].” Whitmoyer subsequently petitioned for a commutation of these weekly payments. In December 1994, the Workers’ Compensation Judge (“WCJ”) granted his petition and directed MCM or Selective to pay Whitmoyer a lump sum payment of $69,994.64. While this commutation resolved his entitlement to disability benefits entirely, MCM remained responsible for Whitmoyer’s ongoing medical bills. Several years later, Whitmoyer obtained a $300,000 settlement from third parties related to his injury and, in April 1999, he entered a third-party settlement agreement (the “TPSA”) with Selective providing that as to past-paid compensation, Selective was entitled to a net subrogation lien of $81,627.87. Selective continued to pay Whitmoyer’s work-related medical expenses in full (without taking credit under the TPSA) for approximately thirteen years, until September 2012. At that time, Selective filed a modification petition requesting an adjustment to the TPSA to reflect the medical expenses incurred since the parties entered the agreement. The WCJ found, per the parties’ stipulation, that Selective had paid $206,670.88 for Whitmoyer’s work injury as of February 2013.The WCJ ordered that Selective’s percentage credit be reduced to 26.09% of future medical expenses, up to Whitmoyer’s balance of recovery amount of $189,416.27. Whitmoyer appealed to the Workers’ Compensation Appeal Board (the “Board”), arguing that the TPSA was unenforceable because neither he nor his counsel had signed it. The Pennsylvania Supreme Court granted allowance of appeal to determine whether the Commonwealth Court erred in concluding that the term “instalments of compensation” in section 319 of the WCA encompassed both disability benefits and payment of medical expenses. Under the WCA, disability benefits were required to be paid “in periodical installments, as the wages of the employee were payable before the injury.” Medical expenses are not. Accordingly, when a workers’ compensation claimant recovers proceeds from a third-party settlement (following repayment of compensation paid to date) as prescribed by section 319, the employer (or insurance carrier) is limited to drawing down against that recovery only to the extent that future disability benefits are payable to the claimant. Appellee, the Marcellus Shale Coalition (“MSC”), filed in the Commonwealth Court’s original jurisdiction a petition for review in the nature of a complaint seeking declaratory and injunctive relief (the “Petition”), on behalf of itself and its members. MSC challenged the validity of several regulations relating to unconventional gas well operations as governed by Pennsylvania’s Oil and Gas Act of 2012 (known as Act 13). MSC alleged that certain provisions were void and unenforceable for multiple reasons, including that they were vague, lacked statutory authorization, and conflicted with other regulations and statutes applicable to the industry. Furthermore, MSC averred that the rulemaking process did not comply with the Regulatory Review Act, and that the Pennsylvania Environmental Quality Board (the “EQB”) failed to develop criteria for the Pennsylvania Department of Environmental Protection (“DEP”) to use in conditioning a drilling permit on relevant factors. The Commonwealth Court issued a single-judge, unpublished opinion and order, granting in part and denying in part preliminary injunctive relief. The Commonwealth Court also issued an order granting in part and denying in part MSC's Application for Expedited Special Relief. The order preliminarily enjoined DEP from implementing and enforcing certain sections of the Act. After its review of the parties' arguments on appeal of the Commonwealth Court order, the Pennsylvania Supreme Court affirmed in part and reversed in part. The Supreme Court affirmed the grant of preliminary injunctive relief as to Counts I and II. As for Count IV, the Court affirmed the grant of relief as to Section 78a.59c, but reversed the grant of relief as to Section 78a.59b(b). In a discretionary appeal, the issue reviewed by the Pennsylvania Supreme Court centered on whether the Commonwealth Court erred in reversing the decision of the Lycoming County Court of Common Pleas, which, in turn, had reversed the decision of the Fairfield Township Board of Supervisors (the “Board”) to allow for the drilling, construction, development and operation of unconventional natural gas wells as a conditional use in a district zoned Residential-Agricultural (“R-A”). The Supreme Court determined after review of the evidentiary record, the Board's decision was not supported by the evidence, and because the proposed use was not similar to any permitted use in the R-A district as required under the Fairfield Township Zoning Ordinance (the “Ordinance”), the Court reversed the decision of the Commonwealth Court.
